Terms of use

These terms apply to anyone who uses the lebonpro.ca site, with or without an account. By using the site, creating an account or publishing content, you accept them.

Who we are

The site is operated by the person or company below, referred to as “we” in these terms.

If you have any questions about these terms, write to us: see the “Contact us” page.

What the site is

Le Bon Pro helps people in Quebec choose a construction contractor. It presents three things:

  • the public licence data of the Régie du bâtiment du Québec and, where the “Sources and licences” page says so, data from other public registers;
  • an administrative score out of 100, which we calculate from that data;
  • reviews written by customers.

The score and reviews are explained in the “Score and reviews” page. The rules for reviews are in the review policy.

What the site is not

  • Le Bon Pro is not an official site. It is not affiliated with the Régie du bâtiment du Québec or with any other public body.
  • The score out of 100 measures a company’s administrative soundness (licence, licence bond, annual fees paid, years in business…). It says nothing about the quality of its work.
  • Reviews express the opinions of their authors, not ours.
  • The site gives no legal, technical or financial advice. It does not replace checking the licence with the Régie du bâtiment, asking for references and proof of insurance, or getting several quotes.
  • We are not a party to the contract between you and a contractor. We do not guarantee its work, its solvency, or that its licence is still in force on the day you sign.

Public data may contain errors or lag behind its source. The official register prevails.

Accounts

Searching for a contractor and viewing its profile do not require an account. A free account is needed to write a review. A company needs an account to claim its profile and reply to reviews.

  • You must be 18 or older.
  • You provide an email address that you control. We verify it by sending a link that lets you choose your password.
  • The information you provide must be accurate.
  • The account is personal. Keep your password secret and let us know if you think someone else knows it.
  • You may claim a company’s profile only if you have the right to act on its behalf. To verify this, we send a code to the email address listed on the licence’s public profile or, if there is none, a person on our team reviews the proof you provide.

You can ask to close your account and have your information destroyed: see the privacy policy.

The subscription

Searching, comparing and writing a review are free. Reading the text of published reviews requires a reader subscription. A company can always read for free the reviews filed about it; replying to a review is part of the company subscription.

The price has not been set yet and no payment is open. During the launch, our team turns on access by hand, on request and at no charge.

Before we open payment, we will state in these terms and on the subscription page the price, the term, the renewal, how to cancel and the refund. No amount will be charged to you without your express agreement.

We may end the free launch access by giving you advance notice.

A subscription never changes a company’s administrative score or its place in the results. It does not get any review removed and does not allow the text of any review to be changed.

What you publish

You keep the rights to the texts you write on the site: reviews, rejoinders to a reply, and company replies.

By publishing them, you grant us a non-exclusive licence, free of charge, for as long as they are published on the site, to host, reproduce, format, display and communicate them to the public and to other users, including through our application programming interface (API). A review is published without its author’s name: you consent to this omission and, to the extent permitted by law, you waive asserting your moral rights in a way that would prevent this use.

You declare that what you write is true to your experience, that you have the right to publish it and that it does not infringe anyone’s rights.

We publish a review according to the rules in the review policy. We may refuse content, decline to publish a reply or remove a review that breaks these rules or these terms. We do not remove a review because a company disputes it, replies to it or pays for a subscription.

You are responsible for what you write.

What is prohibited

On the site, it is prohibited:

  • to publish abusive, threatening, harassing, discriminatory or defamatory remarks;
  • to publish personal information: email address, phone number, street address, full postal code, web address, social insurance number, a person’s full name;
  • to publish text unrelated to work done, or not done, by the company concerned, advertising, phishing or spam;
  • to publish a fake review: about a company you were not a customer of, written or bought by the company, a relative or a competitor, or repeated under several accounts;
  • to offer or ask for money, a discount or a benefit in exchange for a review or its removal;
  • to impersonate another person or another company;
  • to collect the site’s content in bulk (bots, scraping) or to resell it without a written agreement with us;
  • to get around the site’s limits or security, or to try to access another person’s account or the parts reserved for our team.

Intellectual property

The site, its name, its logo, its layout, its code, the method for calculating the score and the texts we write belong to us or are used with permission. You may view them and make personal use of them. Any other reproduction requires our written consent.

The public data we present belongs to its sources and follows their own licences, set out in the “Sources and licences” page. You may reuse it under those licences, not under these terms.

Warranties and limits of liability

We do our best to keep the site accurate and available, but the data comes from sources we do not control and the site is provided as is, with no guarantee that it is error-free or uninterrupted.

To the extent permitted by law, we are not responsible for the decisions you make based on the site, for a contractor’s work or conduct, for content written by users, or for indirect damages or lost profits.

To the extent permitted by law, our total liability to you for any claim related to the site is limited to the amounts you paid us in the last 12 months.

Nothing in these terms excludes or limits our liability for our intentional or gross fault or for bodily or moral injury, or takes away the rights the law gives you as a consumer.

Suspension and termination

We may suspend or close an account, limit access to the site or remove content when these terms or the law are not respected, or to protect people or the site. Unless the law or security prevents it, we give you the reason.

You may stop using the site, or ask to close your account, at any time.

Changes

We may change these terms or the service. The date of the version is at the top of the page. If a change significantly affects your rights, we will notify you by email or on the site before it applies. Using the site after that date means you accept it.

Governing law

These terms are governed by the laws of Quebec and the federal laws of Canada that apply there. The courts of Quebec have jurisdiction, without depriving a consumer of the right to go to the court of their home district where the law allows it.

If any part of these terms is found invalid, the rest continues to apply.
